Terms of Use
DRAFT, NOT LEGAL ADVICE. Must be reviewed by counsel before launch. Effective date: October 20, 2026 | Last updated: October 20, 2026
These Terms of Use ("Terms") are an agreement between you and [LLC LEGAL NAME] d/b/a SolarMatchup ("SolarMatchup," "we," "us"), located at 517 Copper Spur Rd., Bond, CO 80423, governing your use of solarmatchup.com (the "Site"). By using the Site or submitting a request, you agree to these Terms. If you do not agree, do not use the Site.
1. What we are. SolarMatchup is a free referral and marketing service that connects each homeowner with one independent solar installer ("Installer"). We are not a solar installer, contractor, lender, utility, or government agency, and we are not affiliated with any government program. Installers pay us when we deliver a homeowner request to them. We do not provide quotes, install systems, arrange financing, or give tax, legal, or financial advice.
2. Eligibility. You must be at least 18, a U.S. resident, and the owner of the property described, or authorized by the owner, to submit a request. You must provide accurate information and a phone number that you own or are the regular user of. Do not submit information about anyone else.
3. Your request and installer contact. Each request is exclusive: we deliver your information to one Installer only and never resell it to another. If you check the consent box, that Installer may contact you as you authorized; your consent is not a condition of purchase, and you may submit without checking it (in that case we email you the Installer's contact information instead). You may revoke consent at any time (see Section 5). We do not guarantee that the Installer will contact you, provide a quote, or offer any particular price, product, financing, or savings.
4. No endorsement; your dealings with Installers. We verify each installer's business registration, state contractor license where required, and proof of general liability insurance at onboarding. However, we do not endorse, guarantee, or supervise any Installer. Any contract you sign is solely between you and the Installer. Review it carefully, verify the Installer's license with your state, and consider getting other quotes on your own. We are not responsible for Installers' acts, omissions, products, workmanship, or representations.
5. Communications and opt-out. Reply STOP to any text, HELP for help; click "unsubscribe" in any email; tell any caller to stop; or email info@solarmatchup.com. We will honor your request promptly, within the time required by law, and will notify the Installer that received your request. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
6. Information on the Site. Savings estimates, incentive descriptions, and other content are general information only and may not apply to you. Incentives change. The federal residential clean energy credit (IRC § 25D) ended for expenditures made after December 31, 2025, so we do not promise any federal tax credit for new installations. State and local incentives may be available; check current incentives and consult a tax professional.
7. Acceptable use. You may not submit false, fraudulent, or third-party information or phone numbers; use bots, scripts, or automated means to submit forms or scrape the Site; interfere with Site security or operation; use the Site to generate leads for resale or to harass anyone; or violate any law.
8. Intellectual property. The Site, the SolarMatchup name, and all content are owned by or licensed to us. You receive a limited, revocable, non-transferable license to use the Site for personal, non-commercial purposes.
9. Privacy. Our Privacy Policy explains how we collect, use, and sell information, including your right to opt out (Do Not Sell or Share My Personal Information), and is part of these Terms.
10. Disclaimers. THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
11. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, SOLARMATCHUP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INSTALLER'S CONDUCT. OUR TOTAL LIABILITY WILL NOT EXCEED $100. Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these Terms limits rights that cannot be waived under applicable law.
12. Dispute resolution. These Terms are governed by the laws of the State of Colorado. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Colorado. These Terms do not contain an arbitration clause.
13. Governing law. The laws of the State of Colorado, without regard to conflict-of-laws rules, except where your state's consumer protection laws apply.
14. Changes; termination. We may update these Terms by posting a new version. Continued use after posting means you accept the changes. Changes do not apply to disputes that arose before the change. We may suspend access for violations.
15. Indemnity. You agree to indemnify SolarMatchup against claims arising from information you submit that is false or belongs to another person, or from your violation of these Terms.
16. Miscellaneous. These Terms are the entire agreement on this subject. If any provision is unenforceable, the remainder stays in effect. Not enforcing a provision is not a waiver. You may not assign these Terms; we may assign them in a business transfer.
