HOA Solar Rights: Can Your HOA Stop You From Going Solar?
The short answer
DOE: "In most cases, yes, you can install solar panels on your home if it is governed by an HOA, though you will likely have to submit a request." Many states have solar access laws that "prevent HOAs from prohibiting or unreasonably restricting solar installations." These laws vary by state.
Steps
- Read your HOA covenants and architectural guidelines.
- Look up your state's solar access law (DSIRE lists solar access policies by state).
- Submit your application before signing a final contract, or make sure your contract allows cancellation if HOA approval is denied. The FTC lists HOA approval as a question to answer before deciding.
- Keep records of submissions and responses.
What HOAs may still control
Depending on state law, HOAs may be allowed to set reasonable placement or appearance rules. DOE notes building-integrated PV options exist for aesthetics.
